01Agreement to these terms

These Terms of Use (the "Terms" or "EULA") form a binding agreement between you (the "User," "you," or "your") and sima ("Developer," "we," "us," or "our") governing your download, installation, access, and use of the mobile application Squid Winner and any related updates or content (collectively, the "App").

By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not download, install, access, or use the App.

02Eligibility

You must be at least 13 years of age (or the minimum digital-consent age required in your jurisdiction, if higher) to use the App. If you are under 18 (or the age of majority where you live), you may use the App only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

You represent that you are not prohibited from using the App under the laws of Bangladesh or any other applicable jurisdiction.

03License grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial entertainment use.

You do not acquire any ownership rights in the App. All rights not expressly granted are reserved by sima and its licensors.

04Description of the app

The App is a 3D single-player entertainment game inspired by the classic "red light / green light" playground game. You control a character, race toward a finish line while a signal mechanic pauses movement, and compete against AI-controlled opponents. Gameplay is local on your device.

The App is not:

• an official product of, or affiliated with, any third-party television series, studio, network, or rights holder;
• a gambling, betting, or real-money game;
• a financial, investment, wallet, or cryptocurrency service;
• a social network or user-generated content platform.

Any resemblance between the App's mechanics and any well-known media property reflects a shared cultural playground game, not endorsement, sponsorship, or affiliation.

05Acceptable use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

• Reverse engineer, decompile, disassemble, or attempt to derive source code from the App, except to the limited extent permitted by mandatory law;
• Modify, adapt, translate, or create derivative works based on the App;
• Copy, distribute, sell, rent, lease, sublicense, or commercially exploit the App;
• Remove, obscure, or alter any proprietary notices;
• Interfere with, disrupt, damage, or gain unauthorized access to any device, network, or service;
• Introduce viruses, malware, or other harmful code, or exploit security vulnerabilities;
• Use the App to cheat, automate, or unfairly manipulate gameplay in a way that harms other users or services, if shared features are added later;
• Use the App in any way that violates applicable law, including the laws of Bangladesh and the laws of the place where you use it;
• Use the App to create, host, or distribute content that is illegal, exploits or endangers minors, constitutes hate speech or harassment, is sexually explicit, promotes self-harm or real-world violence, infringes third-party rights, or deliberately misleads users about the App's nature or affiliation.

Violation of this section may result in immediate suspension or termination of your license to use the App, and may be reported to authorities where required by law.

06Intellectual property

The App, including its software, design, graphics, audio, text, logos, and other materials (excluding third-party assets used under separate licenses), is owned by sima or its licensors and is protected by copyright, trademark, and other intellectual property laws of Bangladesh and international treaties.

Third-party libraries, engines, models, or assets remain subject to their respective licenses. Nothing in these Terms transfers any third-party rights to you.

If you believe the App infringes your intellectual property rights, contact us at mtsimaakter@proton.me with sufficient detail for us to investigate.

07Updates & availability

We may provide updates, patches, or new versions of the App. You may need to install updates to continue using it. We may modify, suspend, or discontinue the App, in whole or in part, at any time, with or without notice, and without liability to you, to the maximum extent permitted by law.

The App is provided over third-party distribution platforms. Platform availability, device compatibility, and store policies are outside our full control.

08Fees

The App is currently offered free of charge. We do not process in-app purchases, subscriptions, or real-money transactions in the current version. If we introduce paid features in the future, we will disclose pricing and applicable terms before charging you.

09Privacy

Our collection and use of information is described in our Privacy Policy. By using the App, you acknowledge that policy.

10Accounts & user content

The current version of the App does not require account registration and does not host user-generated content such as public posts, chats, or shared media. If we later add accounts or user-generated content features, we will update these Terms and, where required, obtain your agreement to additional rules, including reporting and moderation mechanisms.

11Disclaimer of warranties

To the maximum extent permitted by applicable law, the App is provided "as is," "as available," and "with all faults," without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the App will meet your requirements, be uninterrupted, secure, or error-free, that defects will be corrected, or that the App is available in every jurisdiction. You use the App at your own risk. Some jurisdictions do not allow the exclusion of certain warranties; in such cases the above exclusions apply to the fullest extent permitted by law.

12Limitation of liability

To the maximum extent permitted by applicable law, sima shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your access to or use of (or inability to access or use) the App.

To the maximum extent permitted by law, sima's total aggregate liability arising out of or related to these Terms or the App shall not exceed the greater of (a) the amount you paid us for the App in the twelve months preceding the claim, or (b) one United States dollar (USD $1.00) or its local-currency equivalent.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the mandatory laws of Bangladesh or other applicable law, including liability for death or personal injury caused by negligence, or for fraud.

13Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless sima and its officers, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any third-party right or applicable law.

14Third-party services

The App may rely on third-party components such as device operating systems, app stores, or open-source libraries. Your use of those third parties is subject to their own terms and privacy policies. We are not responsible for third-party services we do not control, including any distribution platform's own store terms.

15Termination

These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any provision. You may stop using the App and uninstall it at any time. Upon termination, you must cease all use of the App and destroy all copies in your possession.

Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnity, and governing law — will survive termination.

16Governing law & disputes

These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles.

Subject to mandatory consumer-protection rights that cannot be waived, any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved informally by contacting us at mtsimaakter@proton.me. If not resolved within thirty (30) days, either party may submit the dispute to the competent courts of Bangladesh, unless mandatory law requires otherwise in your place of residence.

17Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the latest revision. Material changes will be communicated by updating this page, within the App, or by other reasonable means. Continued use of the App after the effective date of updated Terms constitutes acceptance, to the extent permitted by law. If you do not agree, stop using the App and uninstall it.

18Miscellaneous

• Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and sima regarding the App, superseding prior agreements on the same subject.
• Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
• No waiver. Failure to enforce any provision is not a waiver of that provision.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Language. These Terms are prepared in English. If translated, the English version controls to the extent permitted by law, unless mandatory local law requires otherwise.
