These Terms of Use (the "Terms") govern your download, installation, access to, and use of Squid Winner (the "App"). The App is published by sima ("sima," "we," "us," or "our").
By accessing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App. If you use the App on behalf of another person or organization, you represent that you are authorized to accept these Terms for them.
You must be at least 18 years old and legally capable of entering into a binding agreement under the laws that apply to you. The App is not directed to children. If applicable law permits a person under the age of majority to use the App with a parent or legal guardian, that parent or guardian must review and accept these Terms and supervise the use of any connected wallet.
You may use the App only where doing so is lawful. You are responsible for complying with the laws and regulations applicable in your location.
Squid Winner is a single-player arcade survival and evolution game. You control a squid, consume smaller sea creatures, avoid predators, unlock upgrades, cross eight ocean zones, and face a final boss.

We may add, remove, or change features in later versions. Any material change to wallet use, data processing, purchases, rewards, or blockchain functionality will be disclosed through an updated listing, in-App notice, Privacy Policy, or Terms as appropriate.
To enter the game, you must choose "Connect Wallet & Start" and approve an authorization request in a compatible wallet application. The App uses the Solana Mobile Wallet Adapter protocol to request access to a public wallet address. Refusing or cancelling the request prevents gameplay from starting, but does not otherwise affect your wallet.
The App does not ask for and should never receive your seed phrase, recovery phrase, private key, wallet password, or wallet authentication credentials. Never provide those credentials to anyone claiming to represent the App or sima.

Wallet applications are independent third-party services. We do not control their availability, security, operation, or decisions. Wallet authorization does not create a custodial, fiduciary, brokerage, banking, investment, or financial advisory relationship between you and sima.
Subject to these Terms, sima grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the App on a compatible device for private, non-commercial entertainment.

The App does not currently allow users to upload, publish, or share content with other users. You must not attempt to use technical interfaces in an unintended way to introduce or distribute content.
The App and its code, gameplay systems, designs, graphics, models, music, sound effects, text, branding, and other content are owned by or licensed to sima and are protected by applicable intellectual property laws. These Terms do not transfer ownership of any intellectual property to you.
"Solana," "Solana Mobile," and the names and marks of wallet providers belong to their respective owners. The App uses compatible technology but is not sponsored, endorsed, certified, or operated by Solana Mobile Inc., Solana Foundation, or any wallet provider unless expressly stated by that party.
The App may be distributed through the Solana dApp Store or another authorized distribution channel and may interact with an independently installed wallet. Your use of those services is also subject to their own terms and privacy policies.
We are not responsible for third-party services, store availability, wallet compatibility, network availability, or changes made by a third party. A reference to a third party does not constitute an endorsement.
We may provide updates to improve security, compatibility, gameplay, or legal compliance. Some updates may be required for continued use. We may suspend or discontinue all or part of the App where reasonably necessary, including for maintenance, security, legal, technical, or policy reasons.
You may stop using the App at any time by uninstalling it and, if desired, revoking its authorization through your wallet application. We may terminate your license to use the App if you materially violate these Terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, and dispute provisions — will survive.
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free operation.
We do not warrant that every device or wallet will be compatible, that the App will always be available, or that all defects will be corrected. Nothing in the App is financial, investment, legal, tax, or other professional advice. Wallet authorization is an access step only and is not a recommendation to acquire, hold, transfer, or transact in any digital asset.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, sima will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, opportunity, goodwill, profits, digital assets, or wallet access arising from or related to the App.
Because the App does not take custody of assets or request transactions, you should reject any unexpected transaction or signature request presented in connection with the App. We are not responsible for losses caused by a compromised device or wallet, disclosure of private credentials, malicious third-party software, or actions independently taken through a wallet application.
Where liability cannot be excluded, our aggregate liability arising from the App will be limited to the greater of the amount you paid directly to sima for the App during the twelve months before the event giving rise to the claim or USD 10, subject to any mandatory rights under applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold sima harmless from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the App, your violation of these Terms, or your infringement of another person's rights. This section does not apply to the extent a claim results from sima's own unlawful conduct.
Our Privacy Policy explains how the App handles wallet information and other data. The Privacy Policy forms part of these Terms. The App does not create a sima account or maintain a developer-operated gameplay database.
We may update these Terms to reflect changes in the App, law, security practices, or distribution requirements. We will update the effective date and provide additional notice where required by law. Your continued use after an update becomes effective constitutes acceptance of the revised Terms, unless applicable law requires another form of consent.
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles. Before filing a formal claim, you agree to contact us and attempt in good faith to resolve the dispute informally for at least 30 days.
Unless applicable consumer law requires otherwise, the courts of competent jurisdiction in Bangladesh will have exclusive jurisdiction over disputes arising from or relating to these Terms or the App. Nothing in this section prevents either party from seeking urgent injunctive relief or exercising rights that cannot lawfully be limited.
If any provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. We may assign these Terms as part of a transfer of the App or our business, subject to applicable law.
These Terms and the Privacy Policy constitute the entire agreement between you and sima concerning the App, except for mandatory terms imposed by an authorized distribution platform.
